Rainone Coughlin Minchello is proud to announce Managing Partner, Lou Rainone, was victorious before the New Jersey Supreme Court. The Court ruled in favor of RCM’s client, the Union County Improvement Authority, in the matter of H.C. Equities v. County of Union, et al. In its opinion, New Jersey’s top court agreed with RCM Law and reversed the ruling of the Appellate Division.

At issue was the sufficiency of the information necessary to place a public entity on notice of a potential lawsuit, as is required by State law. Here, the Supreme Court held that a series of letters to the defendants’ attorneys were not enough to satisfy those requirements and would impose an unreasonable burden on a public entity to review all communications as potential notices of claim. Additionally, the Court held that the plaintiff landlord also failed to file either a formal notice with the Authority or seek leave to do so from the trial court in a timely manner. As such, the trial court was right to have dismissed all claims against the firm’s clients.
